Issued by the Bureau of Immigration of the Ministry of Home Affairs, LOCs allow authoritiesatanyportof departure to prevent a person from travelling abroad. While the central government's office memoranda were not ultra vires or “per se arbitrary”, the subsequent empowerment of managers of public sectorbankstoissuerequestsfor LOCs was arbitrary, the court said. “We do not expect public sector banks to do this (issue the request for LOCs),” it said. A division bench of Justices Gautam S Patel and Madhav J Jamdar passed the judgment on a batch of petitions and quashed the LOCs issued to restrain people indebted to public sector banks from travelling abroad. The High Court said that the Bureau of Immigration will not act on those LOCs.
