The bench of Justices A S Oka and K V Viswanathan said the Supreme Court “has, over the last several decades, repeatedly reiterated the higher threshold, mandatedbylawforSection306 IPC (now Section 108 read with Section 45 of the Bharatiya Nyaya Sanhita, 2023) to be at- tracted. They, however, seem to have followed more in the breach.
